"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
This statement is the entirety of the 10th amendment to The Constitution of the United States of America. This short sentence however is a very powerful one.
Now I'm no constitutional scholar or lawyer, but my interpretation is crystal clear. The way I read this portion of the Bill of Rights, is that the federal government is limited to the powers it is granted by the Constitution or granted to it by the States are reserved for the States or the people (voters).
In my opinion, the current administration (as well as some before it both red and blue) are attempting to circumvent the 10th amendment (and others).
This week, The Great State of South Carolina passed a bill that would make enforcement of Obamacare a criminal offense. Read the Fox News article here .
In 2009-2010 thirty eight states have introduced resolutions to reaffirm the principles of sovereignty under the Constitution and the 10th Amendment; Nine states have passed the resolutions. These non-binding resolutions, often called “state sovereignty resolutions” do not carry the force of law. Instead, they are intended to be a statement to demand that the federal government halt its practices of assuming powers and imposing mandates upon the states for purposes not enumerated by the Constitution. Some state concerns of the States are:
- immigration laws
- medical marijuana
- gun rights
Our founding fathers were genius in including the 10th Amendment in the Bill of Rights. It is our responsibility as citizens, voters, and stewards of the Constitution to ensure that the States maintain their sovereignty as guaranteed by the Constitution. I encourage you to engage with your state lawmakers and have your voice heard. We need to stop the Federal Government's power grab and restore the Republic to a government of the people, by the people, and for the people.
